Charges imminent for registered sex offender

WOODSTOCK -- New charges against a violent sex offender who is accused of recently having sex with two underage girls are expected this week.

Kristian Andrew Kolb, 21, of 5769 Gospel St., Mt. Jackson, appeared in Shenandoah County Circuit Court last week for a probable cause hearing on whether he violated his probation. He is being held in the Shenandoah County Jail on a probation officer's warrant, and is accused of violating his probation for a 2008 carnal knowledge conviction by having contact with minors, consuming alcohol, missing his curfew and using online social media websites.

Three affidavits for search warrants seeking evidence from Kolb's residence and cell phone were filed in October, and the man was arrested on the probation warrant in late November. Sgt. Chris Rinker, of the New Market Police Department, had talked to a 14-year-old girl on Oct. 13 and learned she had sex with Kolb.

"The victim stated ... that she tried to pull Kolb's arm away," records state. "The victim advised that Kolb then got on top of her, while she was laying in bed and took her clothes off and 'had sex with me.'"

Kolb was not wearing a condom, they state, and the girl said she gave in because she was scared because the man had been drinking. Rinker spoke with Kolb on Oct. 13, and the man stated he received a call from the victim and they talked about her being pregnant.

According to a Nov. 30 report filed by probation officer Brandon Daisy, the girl and Kolb also had sex in the winter of 2009 at a residence in Mt. Jackson, and the Mt. Jackson Police Department is investigating a report from a 16-year-old New Market girl who stated that she has had sex with Kolb twice since June, once when she was 15.
Charges on all of the matters are expected this week, Assistant Commonwealth's Attorney Ken Alger said in court.

Kolb was convicted on Oct. 1, 2008, of carnal knowledge of a 14-year-old girl and sentenced to five years in prison with three months to serve. He also received three years of probation and was placed on the state police sex offender registry, where he is listed as violent.

Kolb also has five years suspended for convictions of grand larceny and breaking and entering, and violated probation in May when he was convicted of misdemeanor DUI in General District Court. He had a 60-day jail sentence suspended, online records state.
Daisy's report states that Kolb is not to have contact with minors, drink alcohol or use online social networking sites. In court Wednesday, the probation officer discussed the man's Facebook page, and stated that Kolb had 498 friends, many of whom are underage girls.

On the page, Kolb states that he likes to drink, and also had posted sexually suggestive statements, Daisy said.

He lives with his mother, Jeannette, and grandmother. Jeannette Kolb testified that she did not know about her son's limitations of probation and had she known that using social networking sites was one of them, she would have had the computer disconnected.
In the search of the defendant's phone, it was determined that he had received a picture of a 15-year-old girl's breast. Alger pressed Kolb on that Wednesday.

"I let people use my phone all the time," Kolb said. "I didn't know they were on there."
Judge Dennis L. Hupp found probable cause to revoke Kolb's probation and set a final hearing on it for Jan. 12. Bond also was denied for the defendant.
