Man charged with incest had just served time

WOODSTOCK -- A Mt. Jackson man recently charged with incest was released from incarceration only about a month before the sex crimes are thought to have first surfaced, according to Shenandoah County Circuit Court records.
David Keith Mitchell, 30, of 398 Mockingbird Lane, was arrested Dec. 3 and charged with two counts of incest, a day after the crimes were reported. Sheriff's Office Maj. Scott Proctor has said the offenses are believed to have occurred between July and December.
According to a report compiled by probation officer Pattie Hottle, Mitchell was incarcerated until June 25 for violating his probation. He was placed on first-offender status for possession of Delaudid in 2007, and later that year violated his probation on that offense and had new charges of grand larceny brought against him for stealing three vehicles, it states.
Mitchell was released from custody again in April 2008, but was found in violation of probation after being convicted of new charges of larceny and assault in Rockingham County in December 2009. He served six months -- until June 25 -- of his previously suspended sentence, the report states.
Mitchell now has five years and six months of suspended prison time remaining. The report states that, in addition to the incest charges and also a charge of aggravated sexual battery, he has violated his probation again by driving with a suspended license in October and possessing drugs from September to November.
According to an affidavit for a search warrant of Mitchell's person to obtain a DNA sample, an investigator responded to Shenandoah Memorial Hospital on Dec. 2 for a reported sexual assault, and a teenage girl was there complaining of stomach cramps.
