*Lawsuits dismissed in deadly I-81 crash

HARRISONBURG -- A Texas truck driver's time spent as a co-defendant in U.S. District Court civil lawsuits stemming from a fatal crash has ended for now.
Parties on both sides agreed to dismiss the last of five lawsuits against Jose Alberto Sarmiento, of Edinburg, Texas, this week in federal court. He was driving during a snow squall on Interstate 81 near Mt. Jackson in November 2008 and struck a car driven by an Edinburg, Va., woman, whose mother and two young children died.
Lawsuits that family filed resulted in a $1.4 million settlement last fall. What remained was a civil action filed by a Charlotte, N.C., man, who was seeking $500,000 from Sarmiento and his company, Spartan Logistics LLC, based on injuries from also being struck during the crash.
On Monday, attorneys for both sides agreed to dismiss the case without prejudice. A jury trial had been scheduled for June 9.
However, a case dismissed without prejudice can be refiled at a later date.
