*Brother of slain Berryville councilwoman faces new charge

BERRYVILLE -- The brother of slain Town Council member Gail Smith has been indicted in Prince Edward County on a charge of trying to hire a hit-man to kill her, according to a news release from Police Chief W. Neal White.

Timothy R. Smith Jr., of Burkeville, is already in prison at Lunenburg Correctional Center, serving two years for criminal solicitation for murder in June 2008. That plot was against his sister, but wasn't carried out at the time.

July 30 will mark the second anniversary of Gail Smith being found shot dead in her Pickett Court home.

Her brother was served June 28 with another solicitation to commit murder charge, according to the news release. The murder is still being investigated, it says.
