Sex with underage girl nets man prison term

Judge revokes probation from 2008 conviction

WOODSTOCK -- A Mt. Jackson man must spend almost nine years in prison for having sex with an underage girl for the second time.
In Shenandoah County Circuit Court on Wednesday, Judge Dennis L. Hupp sentenced Kristian Kolb, 22, to 10 years in prison for carnal knowledge of a 14-year-old girl, according to court records. Six years of that sentence was suspended.
Along with the new prison time, Hupp revoked four years and nine months -- all that was possible -- of Kolb's probation for a 2008 conviction of having sex with another 14-year-old girl. A five-year suspended sentence the defendant has for grand larceny and breaking and entering convictions remain unrevoked.
In a plea agreement reached in May, sentencing was left to the court on the latest carnal knowledge charge, while a charge of being on school property after registering as a sex offender was dropped.
In the most recent sex offense, Kolb, who was 21 at the time, called and texted the girl in October asking to come to her residence, a complaint states. Although the victim did not want him over, he still arrived, talking with the girl outside until following her inside, getting on top of her and eventually having intercourse, it states.
The two had sex in the winter of 2009 as well, records state.
Kolb also violated his 2008 probation by maintaining a Facebook account with many underage girls as friends, sexually suggestive comments and indicating that he liked to drink, officials have said. The defendant is not to consume
alcohol.
As part of his probation upon his next release from prison, Hupp ruled that Kolb cannot have an Internet account in his name, use social media unless it is required by an employer or have unsupervised contact with girls under 18 who are not relatives.
Also Wednesday the court ordered:
• Charles Allen Patton, 38, of Gallagher, W.Va., to serve two years in prison for grand larceny and entering a building to commit assault and battery.
He owes W.L. Construction & Paving Inc., of Stephenson, $9,954.87 in restitution, records state.
• Kevin Dywayne Johnson, 41, of Fairfax, to serve one year and four months in prison for writing bad checks. He owes GNC Antiques $766.79 in restitution, and the Strasburg Emporium $630.08, records state.
• Anthony Bruce Smith, 41, of Clinton, Md., to serve three months in jail for petty larceny. His confinement is delayed until Aug. 10.
• Anthony Dwaine Richards, 42, of New Market, to serve three months in jail for failing to report a crash. His confinement is also delayed, until July 29.

I'm glad the Courts and the Commonwealth Attorney values our children so much as to allow for any suspended sentence for this predatory sexual offender.
