*W.Va. bank sues over theft of debit, credit information

WINCHESTER -- An attorney for the Bank of Charles Town has filed suit in Jefferson County, W.Va., Circuit Court against N/L Entertainment LLC, which operates the Alamo Drafthouse Cinema in the city, for failing to protect customers' credit and debit card information.
The complaint sent to Lisa Limoges, managing partner of the company, states that N/L Entertainment LLC "was negligent in failing to prevent the theft of debit card and credit information of its customers" at the theater during the early part of September.
The bank is requesting almost $30,000 plus interest from the company to cover at least 232 purchases made using stolen cards.
The company's attorney, Curtis G. Power III, filed a motion to dismiss on Dec. 16, claiming that the court "lacks personal jurisdiction over it."
The statement requests not only dismissal of the lawsuit, but that the company be awarded any costs and attorney's fees associated with the defense.
The affidavit of Lisa Limoges states that, "N/L Entertainment LLC has never applied for or received a certificate of authority to conduct business or affairs in the State of West Virginia."

I never received an explanation of why my credit card was compromised for just over $1000 but I would like to warn others not to use credit there pay for the movie and dont buy anything else.My credit card company forgave all the charges but I had to have a new card issued and had to write 3 letters to them to advise the charges were not mine and still they issued another card so i ended up with 2 new accounts and had to again change all my bill payers twice and i still find my latest card being declined at some places if they are not my usual charge history accounts.
Excellent defense. You don't say that you aren't negligent, just that you do not conduct business in WV. You probably should have denied liability as a throwaway line in the affidavit.
