No violations found in pedestrian crash

WINCHESTER -- A state investigation found no violations at an assisted living center from which a patient wandered off and was struck by a car earlier this winter.
Young-Ja Park Kim, 74, was killed Jan. 30 after she was struck by a pickup as she walked in the westbound lane of Va. 7 just west of Blossom Drive (Va. 815) in the early morning hours of Jan. 30.
Kim was a resident of Hilltop House, located at 111 Denny Lane.
The facility immediately reported the incident to the Virginia Department of Social Services, according to the DSS website. That triggered an investigation, which was completed March 1, that found no violations at the site.
"It has been determined that the facility followed their missing persons policy and procedure," the website says. "There is also a process in place for documenting weekly operational checks of personal wireless alarm devices for each resident.
As is required, the doors have a delayed egress mechanism that functioned adequately upon testing during the inspection." Staffing levels were adequate, it says.
Eileen Guertler, director of public affairs for the Virginia Department of Social Services, said five areas were reviewed. These included administration, staffing, resident care, buildings and grounds, and emergency preparedness, according to the website.
"It found that everything was adequate," Guertler said.
The DSS's Division of Licensing inspects assisted living centers yearly and on a complaint basis, she said.
"If they find the facility in non-compliance, they go back again and do additional [inspections]," Guertler said.
She said the department couldn't release any information about Kim.
These included not checking whether a potential resident was on the sex offender registry prior to being admitted, the lack of a mental health agreement on file for a patient's service provider and failure of a worker to have enough annual training.
