Brother of slain Berryville councilwoman charged

BERRYVILLE -- Timothy Smith Jr. remains held without bond after his arrest Tuesday by authorities in Prince Edward County on a charge of solicitation to commit murder against his sister, Gail Smith, according to Berryville Police Chief W. Neal White.
Berryville police investigator Greg Frenzel presented information to a grand jury in Prince Edward County Circuit Court on April 17 related to the July 2009 murder of town resident Gail Smith, White states. The grand jury indicted Timothy Smith on the single count and a judge ordered the defendant to remain held without bond at the Piedmont Regional Jail pending a hearing set for Thursday.
Police found Gail Smith, a member of town council at the time of her death, in her home, dead from a gunshot wound.
A grand jury in Prince Edward County had indicted Timothy Smith for the same charge but the commonwealth's attorney asked a judge in January to dismiss the count because prosecutors had a problem bringing a necessary witness for scheduled appearances.
No one has been charged with Gail Smith's murder. The slaying remains under investigation by members of the Berryville Police Department, the Clarke County Sheriff's Office and the Virginia State Police Bureau of Criminal Investigations.
