Supreme Court upholds key part of Obama health law

WASHINGTON (AP) -- The Supreme Court on Thursday upheld the individual insurance requirement at the heart of President Barack Obama's historic health care overhaul.

The decision means the huge overhaul, still only partly in effect, will proceed and pick up momentum over the next several years, affecting the way that countless Americans receive and pay for their personal medical care. The ruling also hands Obama a campaign-season victory in rejecting arguments that Congress went too far in requiring most Americans to have health insurance or pay a penalty.

Breaking with the court's other conservative justices, Chief Justice John Roberts announced the judgment that allows the law to go forward with its aim of covering more than 30 million uninsured Americans.

The justices rejected two of the administration's three arguments in support of the insurance requirement. But the court said the mandate can be construed as a tax. "Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness," Roberts said.

The court found problems with the law's expansion of Medicaid, but even there said the expansion could proceed as long as the federal government does not threaten to withhold states' entire Medicaid allotment if they don't take part in the law's extension.

The court's four liberal justices, Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor, joined Roberts in the outcome.

Justices Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas dissented.

"The act before us here exceeds federal power both in mandating the purchase of health insurance and in denying non-consenting states all Medicaid funding," the dissenters said in a joint statement.

Republican campaign strategists said presidential candidate Mitt Romney will use the court's ruling to continue campaigning against "Obamacare" and attacking the president's signature health care program as a tax increase.

"Obama might have his law, but the GOP has a cause," said veteran campaign adviser Terry Holt. "This promises to galvanize Republican support around a repeal of what could well be called the largest tax increase in American history."


Surprising that it passed in its entirety. Roberts more concerned about the honor of his court than playing politics.

Good, at least now the insurance companys cannot deny a person insurance if they have a pre-existing condition. And the people who choose not to get insurance just because they think it is ok. This just makes the people who have insurance have to cover for them, we get higher insurance rates because the doctors and hospitals charge people who have insurnace more for services. The ones that don't have insurance usualy don't pay or it is written off for them by the hospitals. Then we have people who get insurance thru there jobs and the insurance company will not cover pre-existing conditions and they somehow come up with that its pre-existing and they will not cover the expense of the doctors or hospital and then since you have insurance the hospitals make that person pay because they are not low income enough.
This health care plan makes insurance companys cover for pre-existing conditions and this should have been made happen all along.

Obama lied to us when he said this would not be a TAX INCREASE...SCOTOS just confirmed it IS a tax increase.

Why is it enforced by the IRS then? Wait til the IRS makes you prove you're insured or pay a tax penalty. Your bank accounts and assets will get tax liens slapped on them and your wages will be garnished for not paying this unfair tax.

Better hope for a REPEAL...

I am very glad Steve is paying attention. This takes away the normal "working mans" choice of coverage and gives the government more control over you. What's next, are they going to require you to buy an electric car? People, please read up on OBAMACARE. The only people that truly benefit are uninsured or unemployed. The issue of pre-existing conditions does need to be resolved but this is definitely not the way. Steve is also right about the IRS getting involved in your business even more so. People that do not work or have no money do not worry about the IRS. REPEAL...

Each individual needs to think of how this bill directly affects them and then make an educated choice. The government is basically stripping you of your choices and throwing you a smokescreen to confuse you. The current system does work but has some flaws that need fixed. OBAMACARE REPEAL.

We are all paying a big price now! There is no easy solution but you are aware of the outrageous price we all pay for health.

The ultimate goal is to get rid of the blood-sucking insurance (for profit) companies, but they have a strong lobby influence. We need national health care whereby health care is a right of every citizen at an affordable price. Actually Medicare works! And other than getting rid of fraud or waste, it could be the model. Every working person has been paying into this all of their life. It's not a freebie!

We cannot continue in a divided nation! This political nonsense is draining everybody. If we had some of the millions being spent on these drawn-out elections, we could solve many issues.

Vote for Romney and you will get George Bush revisited. The Republicans like to worship their old idol Reagan and "wish" for the good ole days. Those days are gone forever. It took years for our decline and we can all thank that guy who stole the election - Bush. He got us in this mess and we must dig out.

To all the young people out there, for the first few years anyway, until all the insurance companies are put out of business and we get single payer, government run un-health care, just pay the fine, It's way cheaper for you and if you get sick you can just get insurance then. ...in fact everyone go ahead and quit paying insurance premiums. If you get sick you can just sign up and get taken care of. The fine (oops I mean tax) is so much cheaper. Our chickens are coming home to roost! whoop! whoop! Can't wait for those taxes to kick in in 2013. ...oh and to anyone wanting to sell your home, better get it done before 2013 because otherwise you have to upgrade all your appliances to energy efficient in order to sell...and you won't be allowed to give a monetary subsidy for the next people because they may not do it. Wow! Obama care is so cool. Now that it's passed I hope you all learn whats in it. So exciting!

The November election is really the most important thing. Bouncing the greatest deficit producing, tax expanding President in the history of the country is all that really matters. Obamacare can be dealt punishing blows later.

Focus on removing the socialist in November.

The line between a liberal and a communist gets fuzzy at times. Then again, the line between a liberal and an anarchist, a liberal and a socialist or a liberal and a coward gets a little fuzzy too.

Obama has 130 days until he is served walking papers on November 6th. Dems can't feel good about real possibilities of losing Virginia, Pennsylvania, Florida, Colorado, Michigan and Wisconsin.

Let them have their fun with the most massive tax hike the world has ever seen. I am guessing the smiles will be hard to come by on Nov. 6th, 2012.
