Trial set in deputies' pay lawsuit

A lawsuit accusing Frederick County of cheating dozens of current and former sheriff's deputies out of overtime pay may go to trial next spring.

Federal Judge Michael F. Urbanski on Thursday in U.S. District Court in Harrisonburg entered an order scheduling the civil case for a jury trial from March 25 to 27, according to online records. Urbanski's order leaves open the possibility of parties entering into mediation which could result in a settlement.

More than 50 current and former deputies of the Frederick County Sheriff's Office claim in a lawsuit filed in April the county and the agency failed to fully compensate them for "gap pay" as mandated under state code. The plaintiffs claim they are owed overtime pay dating from 2005 to January.

Leesburg attorneys Harold R. Showers and Timothy P. Bosson represent the plaintiffs. Salem attorney Jim H. Guynn Jr. represents Frederick County; Leslie A. Winneberger and William F. Etherington, of Richmond, are counsel for the sheriff's office.
