Calif. man to be tried on child porn counts faces local charges

Following his trial -- scheduled to begin Oct. 1 -- on child pornography charges, a California man will face a slew of charges in Frederick County.

John Stuart Dowell, 45, of Santa Cruz, is charged in U.S. District Court with one count of transmitting child pornography online and 12 counts of filming child pornography knowing the film could be sent out of state or out of the U.S. or transmitting it via computer, according to online court records.

On Tuesday, Dowell's attorney, Darren Bostic, withdrew a motion for a bond hearing scheduled for Wednesday, describing it as "moot" since pending state charges would keep him in custody.

In Frederick County Juvenile and Domestic Relations Court, Dowell faces one more charge than he does in federal court: a single count of producing child pornography, two counts of indecent liberties with a minor, three counts of object sexual penetration and four counts each of forcible sodomy and aggravated sexual battery, said Frederick County Sheriff's investigator James Galbreath, who serves on the Northern Virginia-D.C. Internet Crimes Against Children Task Force.

All of those charges are felonies, he said.

While the warrants for the state charges were obtained in October, they haven't yet been served against Dowell. Galbreath said they'd be served following the resolution of the federal case.

He said the local investigation involves the same 3-year-old victim as the federal case.

According to online court documents, Dowell's sister turned into authorities a video depicting him allegedly molesting the toddler. He's alleged to have done that while staying in Frederick County. Online federal court records also allege Dowell filmed himself sexually abusing a prepubescent girl.
