A Front Royal man faces two counts of sodomy with a victim less than 13 years old after being indicted Tuesday in Warren County Circuit Court.
Timothy Michael Rumage, 27, of 313 Polk Ave. is accused in a criminal complaint of committing sodomy with two girls, one 9 years old and the other of an unspecified age.
The criminal complaint signed by Detective Jason Winner states that he began investigating Rumage after fielding a report of child sexual assault from the Warren County Department of Social Services. Winner interviewed the two girls on May 8 about the report, according to the complaint.
The complaint states that the 9-year-old told him that Rumage, who was her mother's boyfriend, entered her room at night on or about May 16 and committed a sex act with her and also touched her breast.
The complaint also states that the behavior the girl attributed to Rumage had been "ongoing" for four months.
Rumage was later interviewed and admitted to the accusations made against him by the two victims, the complaint states.
Rumage's attorney, Eric Wiseley of Strasburg, said his client reported a family history of Huntington's disease, a hereditary disorder that causes nerve cells in the brain to waste away.
Wiseley said Rumage believed his decision-making process may have been affected by the disease. Wiseley asked Circuit Judge Dennis L. Hupp to order that his client be evaluated for Huntington's disease.
Hupp told Wiseley he was unfamiliar with Huntington's disease and asked Wiseley to submit his request in writing. Rumage was returned to the Warren County Jail where he is being held without bail.
In other cases, the grand jury indicted Danny Lee Whitsell II, 37, of 2007 Reliance Road, on charges of malicious wounding and child abuse causing a serious injury.
The criminal complaint by Chris Williams, an investigator with the Warren County Sheriff's Office states that Whitsell's girlfriend, Narisse Everhart, took a 3-year-old girl to the emergency room of Warren County Hospital on April 22, 2011 for treatment of "assault type" wounds.
The complaint states that Everhart told Williams that she noticed a large bruise on the girl's left arm and other bruises over her body in the morning. Everhart told Williams that Whitsell had told her he had gotten up with the girl during the night but did not remember what had happened to her.
A witness identified in the complaint as Whitsell's sister, Krystal Thorpe, said she heard
Whitsell in the bathroom at about 4 a.m. and "heard him mumbling, and it sounded like something was being knocked around," according to the complaint.
The complaint also states that Williams investigated another complaint of child abuse against the same victim a few months later "and the child was voluntarily placed with the grandparents" after the incident. Whitsell is being held without bond in the Warren County Jail.
Everhart also is facing charges of child abuse, malicious wounding and making a false report to law enforcement after the child was taken to Warren Memorial Hospital on Nov. 22 and found to have been "severely beaten" according to an earlier criminal complaint.
The grand jury also indicted John Joshua Carroll, 30, of 1216 Massanutten Ave., Front Royal, on charges of indecent liberties with a child and indecent exposure. The charges on Tuesday were added to those from a previous indictment against Carroll in which he was charged with aggravated sexual battery of a child and taking indecent liberties with a child.
