Second defendant agrees to plead guilty in heroin case

The second of two defendants accused by law enforcement officers of transporting heroin from Houston to New York City agreed to plead guilty Wednesday in U.S. District Court, according to online court records.

Jose Augusto Ferreria-Flores said he would plead guilty to possessing at least 1,000 grams of a mixture containing heroin. The crime carries a minimum mandatory sentence of 10 years under federal guidelines. The plea agreement contains a provision in which prosecutors agreed to recommend a sentence at the lower end of federal guidelines.

The superseding indictment against Ferreira-Flores also charged him with conspiring to sell 1,000 or more grams of heroin.

The plea agreement comes days after Yulissa Eusebio, a co-defendant, also agreed to plea guilty to a charge of possessing at least 1,000 grams of a mixture containing heroin with intent to sell.

A statement of facts accompanying Ferreira-Flores's plea agreement states Ferreria-Flores admitted to law enforcement officers that several people were paying him $2,000 to carry drugs from Houston to New York City. Lab tests proved the substance to be heroin in an amount more than 1,000 grams, according to the statement of facts.

Ferreira-Flores made his admission after a state trooper stopped the car he was riding in for suspected speeding on Dec. 21 on Interstate 81 near Edinburg, according to the statement of facts.

The statement of facts asserts that Eusebio, the driver of the car, falsely told the trooper she had lost her driver's license, then admitted she had lied when the trooper confirmed through state records that her license had actually been suspended.

After a drug-sniffing dog reacted to the presence of narcotics in the car, authorities searched it and found three clear plastic bags of heroin hidden in a cooler being carried inside the trunk, according to the statement of facts.
