Sanitation authority, mining company settle suit

Carmeuse Lime and Stone and the Frederick County Sanitation Authority have settled their federal suit.

The authority's suit against Carmeuse, formerly O-N Mineral, was dismissed from U.S. District Court by Judge Michael F. Urbanski on Wednesday, according to online court records.

The case was brought to federal court in Harrisonburg in February 2011, after having originally been filed in Frederick County Circuit Court.

Carmeuse operates limestone mines near Strasburg, Middletown and Clear Brook, and the sanitation authority uses a quarry on the latter site as a water source. The authority's complaint claimed Carmeuse tried to cut off access to the water because of a disagreement over rezoning costs.

The matter was scheduled to go to trial on April 29, but a settlement was reached instead, Thomas Moore Lawson, who has represented Carmeuse throughout the case, said on Friday.

Both parties will continue to operate at the site as usual, he said.

"[The sanitation authority is] going to continue to pump water at the water plant at Clear Brook," Lawson said.

While he didn't disclose the terms of the settlement, Lawson said, "I think it's a good outcome for both sides."

His sentiments were echoed by Uwe Weindel, the authority's engineer director.

"We've come up with a mutual way of dealing with the issues," Weindel said Friday. "We're still out at that site, and Carmeuse is still, obviously, mining the area. It's really more of a joint effort to settle the differences and move on.

"I think both sides are happy, and probably both sides are disappointed, but I think mutually it works for both of us."

Carmeuse has more than 2,000 employees in 28 plants, and manufactures lime and limestone products used in a variety of industries, including steel manufacturing, power generation, water treatment, and oil and gas drilling, according to a news release from the company.
