Bail set at $50,000 for child sexual assault defendant
By Joe Beck
Mikhail Osterfeld remained in jail Friday on $50,000 secure bond after he appeared at a bail hearing earlier in the week on a charge of aggravated sexual battery against a child younger than 13.
Circuit Judge Dennis L. Hupp initially delayed a decision on Osterfeld's bail until Assistant Commonwealth's Attorney Ilena White could clear up questions about the defendant's prior criminal record, which included charges from Georgia a few years ago.
"We're still in the throes of investigating that information," White said Friday.
A criminal complaint filed in Shenandoah County Juvenile and Domestic Relations Court by Woodstock police officer Travis Pence states he was dispatched on July 10 to investigate a report of a sexual assault committed the day before. The report came from a couple who alleged that Osterfeld had "inappropriately touched" at least one of their two daughters, ages 5 and 7.
The complaint states that Osterfeld, 37, of 221 Waterbrook Court, Woodstock, molested one of the girls while they accompanied him on a walk between 3 and 5 p.m. July 9.
"Osterfeld told them they could take their clothes off if they wanted to swim in the creek known as the 'duck pond,'" Pence wrote.
One of the girls swam in her underwear while the other remained fully clothed in the water, the complaint alleges.
The girls said they went to a park after they were finished swimming. They continued to a woods where Osterfeld asked one of them to take off her clothes, the complaint states. Osterfeld then sexually assaulted the child, according to the complaint.
Police Chief Eric Reiley said Wednesday that Osterfeld was arrested at the police station without incident after he agreed to come in for questioning.
Osterfeld's attorney, John Holloran of Harrisonburg, said Wednesday that Osterfeld, an independent defense contractor working in Afghanistan, had been home on leave at the time of his arrest. Holloran said his client plans to contest the charge.
