Grand jury to consider prosecution evidence in child's death

A grand jury is scheduled to consider evidence against Nicole Miller on Wednesday in a case arising from the death of a 17-month-old boy in early June.

Woodstock police Chief Eric Reiley said Monday that Commonwealth's Attorney Amanda Wiseley will be presenting the case to the grand jury for a possible indictment against Miller. A telephone message left on Wiseley's voice mail was not returned.

Miller, 25, already has been charged with child abuse and child endangerment in Shenandoah County Juvenile and Domestic Relations Court. Police have had little to say about their investigation into the case since Miller was arrested at her apartment at 135 Valley Vista Drive on June 3.

A criminal complaint and other court documents state that police arrived at Miller's apartment shortly after 5 p.m. on June 3 to find the victim unresponsive and not breathing. They identified the boy as the son of Miller's fiancée, Jeremy Alexander Vermillion, also of 135 Valley Vista Drive, according to court records

Authorities say Vermillion was not home at the time of the incident, but he told them he had noticed injuries to his son days before the June 3 incident and did not provide medical attention.

The boy died on June 5 at the University of Virginia Medical Center of injuries described by doctors as head trauma and internal injuries around the pelvic region.

Miller is being held without bond in the Shenandoah County jail.

Miller has told police that she suspected the victim either fell from a bed or her son pushed him while they were playing in the bed.
