Plea agreement reached with defendant in meth case

One of two men accused of conspiring to sell at least 50 grams of methamphetamine around Stephens City and Winchester filed an agreement to plead guilty Wednesday in U.S. District Court in Harrisonburg.

Authorities accused Agustin Solis-Viveros of selling the methamphetamine from November until Jan. 24 with the help of co-defendant Jose Luis Ibarra-Ayon, who is still facing charges in the same case.

Federal prosecutors agreed to drop one count of selling methamphetamine and one count of illegal entry into the United States as part of the plea agreement with Solis-Viveros.

A statement of facts signed by Solis-Viveros describes how he provided 1 ounce of methamphetamine on three occasions to someone identified only as D.R.

"D.R. thereafter distributed the methamphetamine and provided payment to Solis-Viveros," according to the statement of facts. "In turn, Solis-Viveros paid his own source of supply, Jose Luis Ibarra-Ayon."

Authorities also say that D.R. sold methamphetamine obtained from Solis-Viveros to an individual identified as a law enforcement informant on Jan. 3 and Jan. 15.

Law enforcement officials conducted a search of D.R.'s residence on Jan. 24 and found some money used by their informant to buy more methamphetamine earlier in the day, according to the statement of facts. The court document also states that the methamphetamine sold on Jan. 24 turned out to be fake.

D.R. told law enforcement officials that he had been buying methamphetamine from Solis-Viveros for between $1,900 and $2,100 over the previous two months, the statement of facts says.

Law enforcement officials arrested Solis-Viveros and Ibarra-Ayon later when they arrived at a place where they had agreed to deliver methamphetamine to D.R., according to the statement of facts.

The statement of facts identifies Solis-Viveros as an illegal immigrant from Mexico who told law enforcement officials who slipped across the border on foot in 2009
