Toms Brook man indicted in traffic death
By Joe Beck
A Shenandoah County grand jury indicted a Toms Brook man Wednesday on a charge of involuntary manslaughter by drunk driving in a case involving the death of a Strasburg woman in a traffic accident on April 15.
The indictment accuses Nathaniel Scott Garcia, 24, of 108 Southbrook Lane, of unintentionally causing the death of Jeanetta Debra Stickley, 59, while he was driving under the influence.
Stickley died at the scene, according to a criminal complaint filed by Trooper D.A. Mauck of the Virginia State Police.
Mauck's complaint states he arrived at an accident scene on U.S. 11 about one-tenth of a mile north of Mt. Hebron Road. An earlier state police report put the time of the accident at about 12:05 a.m.
Mauck reported in his complaint that a northbound 2006 Hyundai Elantra and a southbound 2006 Saturn station wagon collided.
"An investigation of the crash revealed that the driver of the Saturn had crossed the centerline and struck the Hyundai head on," Mauck wrote.
Mauck said he identified the Saturn driver as Nathaniel Scott Garcia through a state driver's license. Mauck wrote that he noticed "a strong odor of an alcoholic beverage" on Garcia and also noticed Garcia's "speech was slurred, and he was unsteady on his feet."
Mauck wrote that a preliminary breath test showed a reading of .18, well over the legal limit of .08.
Mauck discovered small, unopened liquor bottles in the field next to the accident scene after a witness told him she had seen Garcia hide a black bag in the field, according to the complaint.
Mauck also reported finding two smoking devices, one inside the vehicle and one outside behind the driver's side front tire. Both had a strong smell of marijuana on them, Mauck wrote.
Garcia is also facing charges of possession of marijuana, possession of drug paraphernalia and drunk driving.
He remained in Shenandoah County Jail on Thursday where he is being held without bond.
