Charges dropped in abduction, beating case

FRONT ROYAL -- The prosecution dropped three felony counts and a misdemeanor Wednesday in Warren County General District Court against a Linden man accused of holding another man against his will and beating him up repeatedly over several months.

Assistant Commonwealth's Attorney Bryan Layton told General District Judge W. Dale Houff that he was asking that the case against Richard Wayne Green be dropped "based on evidentiary concerns."

Houff agreed to dismiss the case.

Green, 35, of 19 Sleepy Hollow Road, had been charged with malicious wounding; malicious assault causing injury; abduction by force or intimidation; and misdemeanor assault.

In an interview after the hearing, Layton remained vague on the reasons for dismissal of the charges.

"There were issues with how the facts were coming together," Layton said. "That's about all the elaboration I can give on that one."

Layton said Green, 35, who appeared in court in a jail uniform, would be freed from jail after spending three months behind bars since his arrest in January.

Criminal complaints written by Scott Fletcher and Investigator Jeremy Seal of the Warren County Sheriff's Office accused Green of beating Fletcher at a Linden residence where the victim had been confined for several months.

"He has been beating me and holding me against my will since August 2013," Fletcher wrote in his complaint, dated Jan. 10.

Fletcher said he had been unable to call 911 "because (Green) took my phone away from me."

The injuries inflicted on Fletcher during the alleged beatings included a broken collarbone, bloody noses and wide gashes to his eyebrow, according to court documents.
