Grand jury to hear fatal shooting case

WOODSTOCK — A Shenandoah County man’s manslaughter case goes to a grand jury next week.

Authorities accuse Daniel Scott Harvey, 33, of 600 Stephens Lane, Fort Valley, of fatally shooting Harry Grant Nelson III, 36, of Winchester, the night of March 31. Harvey stands charged with voluntary manslaughter.

Harvey appeared in Shenandoah County General District Court on Friday morning for a scheduled preliminary hearing to determine if the case should go to a grand jury. Harvey stood with his attorney, assistant public defender Simon Herr. Assistant Commonwealth’s Attorney Ilona White appeared for the prosecution.

Harvey waived his right to a preliminary hearing. Judge Amy Tisinger certified Harvey’s charge to the grand jury that meets Wednesday.

Harvey remains held without bond at the RSW Regional Jail in Warren County.

Nelson died of a gunshot wound to the torso about an hour after the shooting, according to information from the Sheriff’s Office. Harvey also suffered injuries during the scuffle that occurred before the shooting. The details of the incident remain unclear.

As part of the investigation, the Sheriff’s Office seized eight guns and ammunition from Harvey’s home, according to a search warrant filed in Shenandoah County Circuit Court.
