Attempted voluntary manslaughter charge dropped, likely to return

WOODSTOCK -- The prosecution dropped a charge of attempted voluntary manslaughter Monday against a New Market man accused in court documents of driving his car at a sheriff's deputy in an attempt to run him over.

The scrapping of the charge against Alan Edward Undem in Shenandoah County General District Court is likely to prove only temporary. Assistant Commonwealth's Attorney Louis Campola said Tuesday that he intended to resurrect the involuntary manslaughter charge, along with others yet to be filed, for indictments before a circuit court grand jury.

Campola said Undem remains held without bail.

"He's not going anywhere," Campola said of Undem. "Other charges will be forthcoming."

Undem, 33, of 9171 N. Congress St., is accused in court documents of driving his 2000 Chevrolet four-door sedan toward deputy C.M Grandstaff after Grandstaff arrived near some basketball courts in Basye to investigate a report of a dispute between a male and female.

The criminal complaint states that Grandstaff approached the car on foot, and Undem "veered toward him into oncoming traffic in an attempt to strike him with the vehicle."

The car speeded away, according to the complaint. Grandstaff later identified Undem though a photo from the state Department of Motor Vehicles, the complaint states.

Prosecutors commonly drop charges in general district court cases, especially when the defendant is being held without bond, and revive them with additional charges before circuit court grand juries.
