Man sentenced in heroin overdose case
WINCHESTER – A Winchester man pleaded guilty in Frederick County Circuit Court on Friday to dealing heroin that led to an overdose death.
David Anthony Proctor Jr., 26, pleaded guilty to distributing heroin, possessing heroin with intent to distribute and possessing a firearm with intent to sell a schedule I or II drug as part of a plea deal.
Reading a proffer of the evidence, Deputy Commonwealth’s Attorney Andrew Robbins said Frederick County Sheriff’s Office deputies responded to a heroin overdose fatality on Dec. 12, 2015. They asked witnesses how the victim received the heroin and launched an investigation.
When a search warrant was later served on Proctor, Robbins said he threw an object that turned out to contain around 2.4 grams of heroin. Officials discovered a firearm at his residence when serving the warrant.
Proctor was sentenced to a total 20 years in prison with 15 years of that sentence suspended.
