WINCHESTER — A city man is accused of sexually assaulting a child within the past two years, according to indictments handed down April 15 by a Winchester Circuit Court grand jury.

Alfonso Jose Modesto, 35, of 1829 Henry Ave., Winchester, was indicted on eight counts of aggravated sexual battery against a juvenile less than 15 years of age.

Modesto also was indicted on eight counts of indecent liberties with a juvenile. The crimes allegedly occurred sometime between Jan. 1, 2006, and Feb. 27, the indictments state.

The panel also indicted:

* Wayne Davis Alsberry, 39, of 1082 Filbert St., Stephens City, on one count of possession of cocaine on Nov. 30.

* Bernie Lee Bittinger, 30, of 122-3 Ward Ave., Winchester, on one count each of check forgery, passing a forged check, and obtaining money by false pretenses on Sept. 18, 2006.

* Justin Jay Garcia, 27, of 1337 Commerce St., Winchester, on one count each of assault and battery of a law enforcement officer and resisting arrest on Jan. 6.

* James Andrew Driver, 46, of 421 Wharton Circle, Winchester, on one count of unlawfully throwing a missile into a building occupied by one or more persons on March 1.

* Tyrone Graham, 42, of P.O. Box 811, Capon Bridge, W.Va., on one count each of grand larceny and possession of Oxycodone on Jan. 29.

* William Gayle Middleton, 24, of 4200 Valley Pike, Winchester, on one count of assault and battery of Daniel Edward Chrisman on Jan. 11.

* Jody Ann Hunter, 49, of 619 S. Braddock St., Winchester, on one count of driving under the influence on Aug. 10.

* Jonathan Lee Long Jr., 20, of 213 Little River Drive, Winchester, on one count of domestic assault Feb. 22.

Long had previously been convicted twice of assault and battery against a family or household member within the last 20 years.

* Robert Lee Taylor, 43, of 242 Shawnee Ave., Winchester, on one count of possession of cocaine on Jan. 19.

* Daniel Lynn Stober, 20, of 20 E. Pall Mall St., Winchester, on one count each of attempted robbery and malicious wounding on Oct. 1.

* Clifford Malcolm MacDonald Jr., 48, of 2432-123 Berryville Pike, Winchester, on one count of driving while under the influence, after having been convicted three or more times of the same offense, on Dec. 22.

* Shae Francois Anderson, 18, of 100 Leiffield Court, Winchester, on one count of unauthorized use of a vehicle, three counts of grand larceny, three counts of credit card theft, four counts of entering a vehicle to commit a crime and one count of petty larceny between Jan. 16 and 17.

* Justin Osburn Costello, 19, of 105 Cherry Hill Road, Winchester, on one count of attempted robbery and two counts of malicious wounding on Oct. 1.

* James Michael Goodman, 22, of 119 Woody's Place, Winchester, on one count each of check forgery and passing a forged check, three counts each of credit card theft and credit card forgery, and one count of petty larceny between Jan. 11 and Feb. 12.

* Kevin Cordell Hamill, 19, of 202 Molden Drive, Winchester, on one count each of robbery, obstruction of justice, resisting arrest and destruction of property on Jan. 12.

* Ernie Lewis Moubray, 34, of 384 National Ave., Winchester, on one count each of attempted carjacking and concealment of merchandise from J.C. Penny on Dec. 28.

* Laura Cary White, 45, of 137 N. Loudoun St., Winchester, on one count of attempted robbery on June 28.

* Joseph Mahlon Pauley, 20, of 467 Giles Mill Road, Bunker Hill, W.Va., on one count of concealment of merchandise from J.C. Penny on Dec. 28.

* Tammy Lee Smith, 44, of 1354 Falling Spring Road, Chambersburg, Pa., on one count of petty larceny on Feb. 4. Smith pleaded guilty to the charge during a hearing on April 15. She was sentenced to three years in the penitentiary, but the judge suspended two years and 9 months from the sentence. Smith also was placed on two years supervised probation.

* Katherine Selinda Thomas, 23, of 1980 Double Church Road, Stephens City, on one count of distributing heroin on Jan. 11.

* David Lee Trump, 36, of 7671 Main St., Apt. 66, Middletown, on one count of petty larceny on Jan. 13.

* Sabrina Ann Williams, 27, of 214 Stafford Drive, Winchester, on one count each of check forgery and passing a forged check on Nov. 6.

* John Hugh Wisecarver III, 21, of 805 Jordan Springs Road, Stephenson, on one count of petty larceny on Jan. 23.

* William Stanley Woodson, 34, of 200 Leafield Court, Winchester, on one count each of check forgery and passing a forged check on Dec. 31.

* Lucy Louise Hardy, 43, of 45 Grapevine Road, Martinsburg, W.Va., on one count of concealment of merchandise from Sears on Jan. 28.
