FRONT ROYAL — Circuit Judge Ronald L. Napier accepted a plea agreement on Tuesday in the case of a local man charged with aggravated sexual battery of a minor.
Jerry Raymond David, 76, pleaded no contest to sexually assaulting a 10-year-old girl in October 2014. Assistant Commonwealth’s Attorney Bryan Layton said that the incident happened when David was wrestling with several children, and the victim, who was the last to wrestle David, was sexually assaulted at that time.
Under terms of the agreement, David was sentenced to 20 years imprisonment with all but two months suspended. David was arrested on June 9, and released on his own recognizance on a $50,000 unsecured bond on Aug. 1, so he has already served the two months the agreement calls for him to serve.
Layton emphasized that he spoke with the victim’s family at length about the agreement and that they were satisfied with the terms. The agreement also prevents the victim from having to testify, Layton added.
David must also complete five years of supervised probation followed by 10 years of unsupervised probation. He must also register as a sex offender, and refrain from any contact with the victim or the victim’s family.
Brad Pollack, David’s attorney, ensured that as part of the agreement, the commonwealth will not pursue any additional charges against David from incidents involving the victim prior to the October 2014 incident.
