FRONT ROYAL – A 20-year-old man must serve 10 years in prison for having sex with underage girls.
Brian Stephan Barclay pleaded guilty in Warren County Circuit Court on Tuesday to one count of rape of a girl under 13 years old and carnal knowledge of a different underage girl without force. Both incidents occurred in August at a hotel in Front Royal where the victims lived at the time, according to Commonwealth’s Attorney Brian Madden.
Judge Ronald Napier sentenced Barclay to 50 years in prison for both sex crimes plus time previously suspended for a prior petty larceny conviction. Napier suspended all but 10 years of the prison terms.
Barclay had consensual sex with a girl younger than 14 years old at a Front Royal hotel on Aug. 13, Madden said. Barclay then had sexual intercourse with a 12-year-old girl
An agreement reached between Barclay’s attorney Eric Wiseley and Madden called for the defendant to plead guilty to both charges. Napier accepted the agreement and Barclay’s pleas and found the defendant guilty of the charges. Napier imposed the agreed upon sentence of 43 years and three months on the rape charge and suspended 40 years of the term. The judge sentenced Barclay to five years for carnal knowledge and suspended one year and nine months of the term.
Barclay, convicted in June of felony petty larceny, also admitted he violated probation by committing the crimes in August. The court had sentenced Barclay to two years with one year and nine months suspended for the crime. Napier, per the agreement accepted Tuesday, revoked the suspended time and ordered Barclay to serve the one year and nine months in addition to the terms imposed for the sex crimes.
Barclay must register as a sex offender and serve probation for the rest of his life. Napier, who ordered him to have no contact with either victim, asked Barclay if he understood that the suspended time of 40-plus years would remain over his head for the rest of his life. Barclay responded in the affirmative.
