Front Royal man charged with sexual battery has previous rape conviction

Front Royal Police on Tuesday arrested a 58-year-old man, who was previously sentenced for rape, on a charge of sexual battery.

Police allege James Hugh Porter was walking down Main and Water with a 25-year-old woman to a group meeting when Porter grabbed her right breast and smacked and groped her right buttock, according to a criminal complaint.

Police allege James Hugh Porter was walking down Main and Water streets with a 25-year-old woman to a group meeting when Porter grabbed her right breast and smacked and groped her right buttock, according to a criminal complaint.

The woman told police she told him to stop and pushed him away.

Porter is alleged to have then told the woman that if she told anyone he would make sure to have her hospitalized, according to the complaint.

The officer was able to observe redness on her right buttock and a small red mark in between her breast from one of Porter’s fingers digging into her skin, the criminal complaint states.

Porter appeared before a magistrate, Leilani Monahan, on Wednesday who ordered him held without bail.

In a bail determination checklist, Monahan noted Porter had an arrogant attitude and was a career criminal starting in 1979.

He is to appear back in court on Oct. 30.

In Dec. 1996 Porter plead guilty to rape, according to court records. He tried some months later to withdraw his plea but his request was denied.  He was sentenced to 38 years with 15 years suspended, court records indicate. He was placed on probation upon his release.

That probation was revoked on Wednesday.

Porter is on the Sex Offender Registry, said Lt. Sarah Seal, a member of the records department at the Rappahannock-Shenandoah-Warren Regional jail.
