FRONT ROYAL — Due to ongoing developments regarding the alleged embezzlement case involving the Front Royal-Warren County Economic Development Authority, Circuit Court Judge Bruce D. Albertson opted to delay initial motions hearings in the town’s civil suit that claims multi-million dollar damages.

Town Attorney Doug Napier said this is an appropriate decision because the case is “factually a very fluid one” and facts are “developing rapidly...as far as who did what.” He noted that the town rushed to file the suit because officials were not sure when the alleged embezzlement began and were unaware of when the statute of limitations would prevent the filing of a lawsuit.

Rosalie Fessier, of the TimberlakeSmith law firm representing the EDA, noted that the defense will be asking that charges against the EDA be dismissed due to its “sovereign immunity” as a governmental body.

A hearing in the case will be held at 2 p.m. Oct. 9.
